If girl loses a memory card, I find it and open it to try and surmise who it belongs to, and it has graphic images, am I guilty of voyeurism or something. On the judges logic she could feel dirty and violated I had seen her naked body...that seems to be the crux of his reasoning. She says she 'feels' abused, so therefore must be abused. I think because teachers (as well as doctors, and other professions) have a duty of care and "should know better". The main issue I think is that it was a teacher and pupil from the same school. The power balance is unequal despite both being "adults" (both might need to do a bit of growing up though). Are teachers regulated by a body with a code of conduct? Pressumably all teachers go on annual child protection and vulnerable adults courses each year? If a 16 old girl was going out with a 40 year old teacher from another school, then that might be OK.
