Any Legal Eagles On Here?

Had a pretty horrific RTA in Nov last year, both cars written off, other party prosecuted for driving without due care etc. No charges against myself (the other driver)

Just been told I can't claim for the cost of replacement car seats for my children, only claim for original cost less wear and tear etc.

Is that right?

Quite possibly. Sadly, general drill with car insurance is accept peanuts valuation for your car then screw them on the personal injury claim,

Probably nothing to stop you suing the other driver privately for the cost of the child seats they've wrecked,

From memory, don't the car insurance say that anything added to the car is part of the home, rather than the car and to claim off them?

Sounds right, I mean are you expecting a brand new car out of the other party or the actual value of the one they wrecked? Having said that, the price of a new kids car seat in the whole scheme of the claim seems trivial, especially as it's difficult to attribute a value to a used one. I mean, it's either capable of protecting your kid or it isn't - if it's not, but was before, then I fail to see why you shouldn't be owed a new one.

This is 8 months after the accident. I really hate to go down the litigation route but the damage it has done to my family is so substantial, and the credit card balance we now have means I have no choice. I wouldn't mind if we'd taken the pi@s buying new seats but for my eldest it was only 12 months old (she was 22 months old at the time) and for the youngest she was only 6 weeks.

It's less than I paid for the pushchair for child no. 3, though (£400). Don't ask.

Err, I'm awfully sorry about this but legal eagles will know less about claiming for car seats or whatever you're talking about than you.

Eagles don't deal with that stuff.

OP, I'm sorry, but there's no way you're getting the new cost of that pram back, you paid too much for it in the first place.

Edit: You mention using credit cards... I'm sorry once again, but really ..... ? Do you require 14k per person per annum to live on?

I'm not sure that this is worthwhile advice but..... if you haven't done so already, have you considered using one of those lawyers that specialise in accident claims on a no win, no fee basis? Yes, they will take a chunk of your payout, but on the other hand if the insurance company think they can stitch you over, they will. If they are dealing with a lawyer, they will be far less inclined to pull fast ones. I don't think that you should lose one penny as a result of this, and I also think you should be compensated for all the time, effort and stress of dealing with it. That's exactly how an accident lawyer will see it.... the bigger the claim they arrange, the bigger their cut. It really might be worth a "free consultation". You are on a rocky road if you try to do this yourself. Good luck in any case.

Seems right, most insurance indemnifies you. It pays the original cost less a proportion for wear and tear. Some policies extend the cover to new for old. If so they pay you the cost of replacing an item that is the subject of an insurance claim with a new item of similar quality.

It's all in the small print.

Get yourself an ambulance chaser on no win no fee. Had two accidents in the same circumstances as yourself .The Insurers are shiesters of the highest order. I can give you a name if you want one.Claim for everything.

I don't mind, the replacement cost is less than the original cost so even with wear and tear I'm still quids in - just thought it couldn't be right, surely insurance exists to protect in these cases? Naive maybe...

Oh and for those who said f&&k me at the cost etc. When our car finally came to rest I had to kick the door open to get out, I had to put my foot on the panel by the boot to pull to the door open to get my youngest out (6 weeks) and then do the same for my eldest. My wife had to climb over my seat to get out. The other car was a 4 x 4 on an 09 plate with just under 7k on the clock and it was a write off. There is no price too high for good quality child seats that work.

You are absolutely right. With mine, 22 months, I put my foot down on the over expensive showy offy styl;e prams, but when it came to the car seat, I bought the best I could find. It could (and probably did in your case) save a life.

If people want to then pass snide judgement on your credit card bills as a result, then f**k them.
