  1. If at the end of the AST neither party has given the required notice (you 1 month, and the landlord has to give 2 months) then the tenancy becomes periodic automatically by law. You don't have to sign a new AST if you don't want to. The landlord then has to issue you a Section 21 notice to quit (with 2 months notice) Basically tell them to get lost if you want to and let them issue a Section 21 notice (or give 1 months notice yourself).   2. If it's a standard AST the tenant has to give 1 months notice (notice period starts from the day the rent is next due). The landlord has to give 2 months notice on the same basis. The 2 month notice isn't enforceable on the tenant. If an AST expires it becomes a periodic tenancy (ie a rolling basis) which continues on the same terms as the AST ie at the same rent. During a periodic tenancy the notice periods are as I have just described.
  3. A gas safety inspection should be done at least once every 12 months. If none has been done then the landlord has committed a criminal offence. Threaten to contact the Health and Safety Executive if you need to. He can either be cautioned, fined up to £5000 or even imprisioned. No inventory means no deductions from the deposit!
  4. OK Thanks just as I thought. Also he is complaining about the top windows not being cleaned. The top of the windows are about 12/13 feet high and I can only reach by standing on the top of a step ladder. I am heavier than the maximum allowable weight stickered on the ladder. I wonder if I can inform him he is failing under the obligations relating to falls in the The Housing Health and Safety Rating System (England) Regulations 2005. From these questions you can gather the landlord is a complete ****, out of his depth in a puddle and I'm just gathering as much mud as possible.
  5. For gas safety inspections what is the leeway for when the inspection is due eg 14 days either side? What kind of offence is it if an inspection isn't carried out. Also the landlord is complaining about the state of the window frames. I guess they're about 100 years ago and are in the same state as they were 2 yrs ago when I moved in. There is no photo/written evidence of their initial condition when I moved in, and so I can tell him to get lost at his threats of deposit deductions. Thanks
  6. I've been issued with a Section 21 to quit and the landlord has to give me 24 hrs notice before viewings for prospective buyers. He has a tendancy to give a time range of say 11am to 12pm and then turning up at say 4pm instead. I'm fed up with this and am I in my rights to refuse entry as he has missed his appointed slot.
