  1. So when you roll over at the end of the AST, the landlord cannot increase the rent?
  2. So if the AST has rolled onto a period tenancy, can the landlord still serve a section 21 notice?
  3. So if the landlord rolls the tenants onto a periodic tenancy after the 1-year AST, is it just 1 month's notice either side? And what happens if the landlord needs the flat back and the tenants don't want to leave? How does that work out? People say that it's safer with an AST.
  4. Got the deposit protection problem sorted - they hang on to it until notified that tenancy is ended. So when the new 1-year AST starts with a 3-month break clause, then can notice be given 1 month before the 3 months are up?
  5. So if tenant agrees to a new 1-year AST with a 3 month break clause, then how does that work the DPS scheme? If the LL pays back the deposit at the end of the initial 1-year AST & then registers a new deposit with DPS for instance, then how can he pay it back if the 3 month break clause is activated (i.e. deposit has been registered for 12 months?)
  6. So if we don't do anything and go for a Period Tenancy then can the LL increase the rent each year? The initial 1-year AST said he could only if "a new AST" and it would be based on RPI Index.
  7. If the LL still wants to go for a new 1-year AST then does that mean he can serve notice on his tenant 2 months before the 6-month breakclause and the tenant, 1 month before the 6 months are up. Am I getting this right? And what if the LL chooses to go for a short furnished AST, i.e. 6 months with a 3 month breakclause. Can he do that after an inital 1-year AST with no break clause? And when would LL and tenant serve notice in that case (1 month before the 3 months are up?).

Hi, After an initial 1-year furnished fixed term AST agreement with no break clause, just 2 month's notice on either side, if the landlord wishes to start a new AST agreement after that one year, can he include a 3-month break clause with 1-month's notice? If so, when the new 1-year furnished fixed-term AST agreement starts, when can he or the tenant give notice? At the end of the first 2 months (2+1) or 3 months (3+1)? Moreover, if the tenants are the same: Does the landlord need to re-register the deposit? Can he just go over the initial inventory check-in again & update? Thanks.
