Free housing for asylum seekers from EU

Thousands of unemployed asylum seekers granted sanctuary elsewhere in the EU can move to Britain and claim free council housing.

A court ruling yesterday opened the door to any poor EU immigrant to travel here and demand a home.

It overturns a Government edict that local councils have no duty to help EU citizens who head to Britain, but do not bother to get a job.

Councils will now have to hand over the keys to a council house to jobless EU nationals with nowhere to live - even though they have never done a day's work in Britain.

Campaign groups warned huge numbers may now head to Britain to take advantage of the "incredible" ruling, including thousands of asylum seekers granted citizenship elsewhere in the EU.

Around 500,000 refugees are thought to have been granted nationality by our EU neighbours over the past decade. They then assume the rights of a person born in that country.

A Somalian woman who travelled to Britain after being granted nationality by the Dutch government brought the case which led to yesterday's ruling.

Judges said that because she did not have a job and was not looking for one, she was a special case. Incredibly, if the woman got a job, she would lose the right to a free house.

Sir Andrew Green, chairman of Migrationwatch UK, said the housing would have to be provided at taxpayers' expense. He added: "This case should be appealed or, if necessary, the law has to be changed."

As EU nationals, jobless migrants can freely come to live in Britain. But the rules state that to continue to benefit from this right they must either find a job or have enough money to be self sufficient.

Those who have no money and do not bother to find work are "economically inactive".

They lose their right to live here freely, and become subject to immigration controls.

But when they fall into this category they become entitled to a free council house.

Jobless Dutch citizens Has-san Ismael and Nimco Abdi took Barnet Council to court claiming they have a right to council housing.

Their lawyers said that because they are "economically inactive" they are not legally entitled to free movement within the EU, despite their Dutch citizenship.

Therefore, they are technically subject to immigration controls and because of this, entitled to housing. Barnet Council, backed by Deputy Prime Minister John Prescott, disputed this.

But they were overruled by the Court of Appeal - and Mr Ismael and Mrs Abdi can now claim free housing.

Mr Ismael, a widower who is the sole carer of his two young children, arrived here in February 2004, four years after being given Dutch nationality.

Mrs Abdi, who has three daughters, fled Somalia in 1993. After living in Kenya, she went to Holland and given nationality in 1998, moved to Britain three years later.

Both claim they cannot work because of childcare responsibilities - and this makes them "economically inactive".

People in this category could, in theory, be forcibly removed from the UK having not sought a job within "reasonable time" of arriving here.

But deportation proceedings are rarely, if ever begun, as they must be halted if the person takes steps to find a job, such as securing an interview.

Lord Justice Buxton, passing verdict yesterday, said their admission of being subject to immigration control entitled them to housing.

Conservative Immigration spokesman Damian Green said the Government should change the regulations.

"The consequences of this interpretation of the law are ludicrous," he said.

Matthew Elliott, chief executive of the Taxpayers' Alliance, said: "This case has huge implications for taxpayers, particularly since other EU member states do not offer this benefit."

Another thing relating to people from the accession states...........When these countries entered the EU in May 2004 , Blair said anyone not wanting to work would be put out of the country.....and not get benefits...

This of course is totally unenforcable as the government has no right to restrict the entry and residence here of EU nationals.....Also as they were given the right to work the government is legally obliged to pay them benefits...........Although they are supposed to have been here a year before claiming there is no way of proving they have been here for less time than that.

We (labour party) promise you- you never will have to work ever in your life. Your expenses will be paid by some sods who work hard, who pay their taxes but who never cannot have their houses. Every refugee from every corner of the world- come here.

So that one day when there is a backlash, even those who legitimately came here could be driven away!

You should stop wasting your time reading The Daily Fascist. Unless, of course, it peddles the sort of xenophobic lies that you want to hear. Instead, try reading some real facts e.g. :

The scorecard for the UK economy

First on the list of myths to be shattered is the saloon bar favourite - that Britain is being "flooded" by immigrants. In fact, the UK has taken in one migrant per 1,000 natives a year since 1991. Germany has taken in almost four while Greece has absorbed six. Nor is our population growing at runaway levels - about 0.25 per cent a year over the past 13 years ...

Not the sort of fact you probably want to see. But, fact all the same.

This is indeed a country gone PC mad! We now read that a 10 year old is prosecuted for calling another boy '****' - the police and CPS ignoring the fact that the other child had called the 10 year old 'white trash' and that the pair were now friends!

• The UK’s population is projected to rise by 7.2 million from 2004 to 2031 – 6.0 million (83%) of this rise is due to immigration. That’s equivalent to two cities the size of Cambridge every year needing to be built because of immigration.

• 65,000 new homes will be required in England each year for the period 2003-26 for immigrants.

• In 2004 12.0 million non-EU nationals arrived in the UK. How many left? No one knows – we have no embarkation controls.

• In Inner London 57% of all births are to foreign-born mothers.

• Since 1997 about 376,000 asylum seekers have been refused permission to stay here but only 85,000 have been recorded as having been removed from the UK.

Although this ruling may enable those who would not be able to normally apply for a council house (or Housing Association property) will now (according to the above) be able to apply for housing.

This will not mean that they will be able (IMHO - and I work in the area of social housing) to apply for housing and be accepted onto a Housing Register/Waiting list. Normally such individuals would have meant that they had no recourse to public funds and woul dnotbe able to be considered of council/housing association housing.

This will not mean that they get automatically housed - this does not happen - we have allocation policies and waiting lists that are strictly enforced.

Remember the source of the article - hardly the most balanced article.......

Whilst I hate the encumbent Gov't as much as the next man, immigration is a topic that is used to spread fear and distrust.

The Daily Mail is adept at running stories to make the middle classes panic.

Yes, we need to ensure that we have a fair and transparent immigration system, and yes the illigel immigration (hidden) is also a problem, but listen to what I have said.........

Social Housing on a large scale is set up to house those most in need and often looks at time on the waiting list, there is no long term backdoor to housing.

Yes, people who find themselves homeless (as long as they have recourse to public funds) and are found to be unintentional etc will be provided with temporary accommodation.

Please refrain from, as stated, xenophobic and racist attitudes. Yes Labour suck big time, but the troops on the ground in Housing (myself included) work to ensure that housing is allocated 100% fairly.

the government need to start listening to the people or there will be more than a repeat of the brixton riots happening.I'm not being racist,when people's standard of living declines..it's always the immigrants who get blamed(never the chavs with 10 kids who can't be arsed to clean toilets for their dole).
