Landlord witholding deposit

We didn't ask for a specific amount, but highlighted that the court will order 13 to 39 x deposit as compensation (1-3x per contract). A sensible landlord would offer, say, 20x. A gambler would take it to court and hope the court orders less.

Between £6 and £20 k after 30% fees. I actually hope it goes to court, as the judge (do they have judges at these courts?) will realise that they failed to protect deposit 13 times. As not a one off error, they could throw the book at them.

i suppose if they have multiple houses rented out without protected deposits, they could really be in the poop. But they could also claim bankruptcy, that's why i wouldn't give them an extra week for a 'family emergency', hide funds etc. 

what will you do with the monies? towards a house deposit? or rent somewhere cheap for a year, you are 100% sure your next place is not also owned by the same person?

we've bought actually ... so plenty of renovations that need funding. e.g. my fence blew down on the weekend, and garage needs replacing. He's selling the house we rented (hence we were evicted), so unless he's up to his eyeballs in debt on that we should be ok. Also he and his wife have fancy cars .... the bailiffs can get those if needs be.

not if they are on finance as they technically don't own them. 

Good to see a landlord take a bath though! my worry would be a judge being very lenient on them

You sure about this? 

 Accident compensation has a reducer addition effect   ie  lose one leg would pay out more (per leg) than loosing both legs.  This came to me from a specialist lawyer, recounting rather a grisly road accident involving several serious injuries.

 Don't take legal advice from me on housing law 😄, just thinking about the difference between compensation for your losses and damages for his mistake(s). Also whether a judge would think you had been reasonable in your request to settle out of court?    

  I know enforcement can be lengthy and costly, money and assets can be hidden away. Lots of catering businesses are up to their eyes in debt now ...

if we get an offer i will be pragmatic (the typical settlement is 3x for first contract, then 1x for each additional one). If the money needs to be chased my solicitor does that, his fee is 30% of the compensation.

 Even without intentional delaying tactics, just to get to a judgement could be some time away -then there is enforcement...

 

 I had something similar, cowboy central heating fitter. In the end I replumbed it in 15mm and 22mm copper and it works properly now (you can't squeeze a 8 kw through 15mm pushfit, basic stuff)

 The guy was I suspect a serial blagger, and had a lawyer for a mrs with just a mail forwarding adress. Getting a CCJ would have been straighforward, but I'b be pi55ing the wind trying to get it -also he was in a different area and not easy to trace.

I'm not sure to be honest, I'm being led by my solicitor. The landlord has some family issues, which i hope means he will avoid court at all costs.

It's likely he's already made his decision and is waiting until the last minute before committing to put his hand in his pocket. Then you play the delaying game.... the cheque's in the post etc.
