They cant exactly claim in their defence as they so often do that they are "providing a home for the tenant" whilst reserving the right to evict on that basis. Wayward Posted April 15, 2019 Share Posted April 15, 2019 There is always a way around regulation. Want the tenant out? Increase the rent. I think the proposal is to have a mechanism to prevent unreasonable rent increases forcing tenants out but how many tenants will really take legal action on this basis and hire a valuer to give evidence etc??? Where I encounter it, I always take the time to report rudeness or other such bad attitude to management and do my best to have the offender sacked. Each period anniversary is a de-facto contract renewal so presumably either party is able terminate the contract at that point. I am presuming that under a no S21 regime tenancy duration will be negotiated more carefully - with landlord wanting shorter ones and tenants longer ones. Not sure how its going to play out TBH. One model could be to limit rent increases during a tenancy (including a periodic one) to a local rental index so that the landlord can't just increase the rent to a million pounds a month. Within the fixed term you can't put the rent up, but when it becomes a periodic tenancy you can issue a S13 notice, form 4. putting up the rent. It does have rights of appeal to a tribunal though if the rent has been set at an "excessive" level.  There was a HPC'er whose landlord just sent a text/email rather than issuing the correct notice. the HPC'er wisely continued to pay the "old" rent and told the LL the score when he asked where his extra rent was.
