Advice Please

Recommended Posts

Mrs Sannyasin has been taking driving lessons recently but unfortunately her driving instructor is no longer in business. Before he went bust, the missus paid him for 10 lessons and he owes her a lesson. He no longer has his car and has promised to pay her back. This was last week. It appears he is in financial difficulties. Is there any legal way which she can pursue to have the money paid back?

You could probably take him to a small claims tribunal, but they would likely not be sympathetic when it could be shown that the guy is genuinely on his uppers and you are only owed circa 20 quid.

Grin and bear it, it really isn't a lot of money. It isn't a point of principle either as he has gone bust. He hasn't nicked your cash, unless there is something more you are not telling us.

Do you have a car in which he could give her a lesson? If so might be easier to get payment that way than in money. If he (or you) is nervous about a car without dual controls, they could always focus on manouevres for one lesson.

Only a thought, but if he's strapped for cash you could get very irritated trying to pursue him for it. This might be a way he can pay you and keep some dignity.

Unfortunately we cannot use our car for the remaining lessons, as it would invalidate our insurance. Also he actually owes us around £70 or about 3 lessons. We have his landline but no address, can anyone help?

Phone him up and ask him if you could come to some sort of 'arrangement' with regards to his wife.

You can go through the small claims court if the amount is less than £1000.It costs you £30 to make a claim and you can do it online at www.hmcourts-service.gov.uk.

You claim the £30 back too!

You can get all the appropriate forms from the small claims court.
