Circumventing The Contract

I let out my house through an agency. The tenants are great and I think I'm ready to take on the management of it. However, the contract states I need to pay the agent 1.5 months rent if I keep the tenants on, but let go of the agent. Can I get round this by letting it out to a very good friend of mine and have the paperwork allow him to sublet it out to the existing tenants? The tenants are happy for me to do this if it makes a difference.

Can't see why not, your agent is hardly going to find out. Lets face it agents are not the most proactive of folk.

Easier way to do it. Evict the tenants, on paper(using a Section 21 notice, im sure your agent will do it for you :D). Then invite the tenants to reapply for a tenancy, AFTER dispensing of the services of your agent. Do NOT invite them to HAVE a tenancy. This gets rid of any potential subletting issues. I think if you do it this way you do not even have to get them to physically move out.
