ECJ intermediary decision is a victory for brand owner collaboration; REACT reveals more to come

Last week, the European Court of Justice (ECJ) confirmed that operators of physical marketplaces could be held liable for the sale of counterfeit and other illicit goods by market traders. While deemed a significant win for IP owners, the decision also demonstrates the effectiveness of joint-party legal actions – with experts telling World Trademark Review that they strongly encourage more precedent-setting collaborations.

No more dodgy knock offs? No more pirate dvd's, fake Dr Dre's ear torture devices? Goodbye to all the best back door Singapore £10 Gucci, Prada, and Rolex goodies?

Will have to wait and see who's going to monitor this, and who actually gets done/fined.

Doesn't cover eBay then?

Don't know.

Depends on if you classify eBay as a 'physical marketplace'.

I gather they fall into the 'online marketplace' category as they have no physical presence per se.

Buy if dominoes start falling, they could be reeled in I reckon.
