Legal Chiefs Adopt Sharia Law

Islamic law is to be effectively enshrined in the British legal system for the first time under guidelines for solicitors on drawing up “Sharia compliant” wills.

Under ground-breaking guidance, produced by The Law Society, High Street solicitors will be able to write Islamic wills that deny women an equal share of inheritances and exclude unbelievers altogether.

The documents, which would be recognised by Britain’s courts, will also prevent children born out of wedlock – and even those who have been adopted – from being counted as legitimate heirs.

Anyone married in a church, or in a civil ceremony, could be excluded from succession under Sharia principles, which recognise only Muslim weddings for inheritance purposes.

Basically a parallel legal system but makes you wonder if you need to be a Muslim to draw up a Sharia compliant Will?

Quite incredible.

Islam is a miserable belief system and old Mohammed was a demon-obssessed pedophile warlord, but having said that there never has been anything to stop you creating a will that excludes female offspring or those who displease you in whatever way - and includes those who convert out of your faith. As long s its not the default law, fine.

Just read that on the Torygraph.

My take on it, was that this was the usual sort of "they're not proper Christians" propaganda that rag spews out all the time. Because of course, we're all Christians, even if we don't know it. (end irony mode)

Isn't it entirely up to you who you leave your stuff to?

What does this have to do with law?

It's all to do with choice. The underlying law remains.

I expect this kind of lying from the Express. Disturbing that a Telegraph blog endorses it - they bang on about freedom and independence, then cross their arms and say, Some animals are more equal than others.

Tricky contradictions arising from our irrational trust (ie. faith) in opinion formers.

It's a BS article. People are already entirely free to leave their stuff to whoever they want under whatever stupid terms they want to choose. The only exceptions to that are corner cases around spousal and child maintenance where other laws apply anyway.

The bit about some Sharia courts being recognised under the Arbitration Act is a red-herring too. If two sides to any dispute choose to, they can go to binding arbitration if that's what they want, there's no special dispensation for religious nutters of any stripe. The result is only actually binding if the result is compatible with English and Welsh law.
