Us Teen Girl On Child Porn Charge Over Nude Selfies

A 16-year-old Virginia girl was charged with a child porn felony for tweeting her own naked pictures.

The girl, whose name has not been revealed, was charged as a juvenile with "possession, reproduction, distribution, solicitation and facilitation of child pornography," Stephanie Williams-Ortery of James City County Police told the Huffington Post.

"The young lady acknowledged that she had posted the pictures of herself [and] the mother acknowledged that the photos were of her daughter," the officer said.

It’s not clear how many lewd pictures are involved in the case, but they were posted sometime around January 30. The police were warned by an anonymous tip.

Being a juvenile, the girl is not required to register as a sex offender under Virginia law. But she would have to comply with a court order, which is likely to tell her and her parents to take a sexting education program.

Some people in the community don’t agree with the harsh charge brought against the teen, according to local broadcaster WAVY.

“I don’t think she should be charged with child pornography, because she is a child herself, but if she was 18 or older of course,” said one local parent, Emily Altman.

“That is distributing,child pornography?” said another parent, Dometre Mobley. “She is a child, I don’t know what to think of that really.”

That's exactly what legislators are paid to do: think up "what if" situations and frame the law accordingly.

This case shows that they have failed on this law. I don't suppose there's any chance they will face sanction for it?

Having a felony conviction means being banned from voting for life (in all federal government elections and most others), that no reputable university or higher education college will admit you, and that you are almost unemployable (unless you start your own business). I cannot see any possible justification for this girl suffering those consequences. Attending a sexting awareness course is probably a good idea, but the consequences of any felony conviction (regardless of the actual sentence) are way beyond what is justified in this case.

In the United States, where the felony/misdemeanor distinction is still widely applied, the federal government defines a felony as a crime punishable by death or imprisonment in excess of one year. If punishable by exactly one year or less, it is classified as a misdemeanor.

This happens here too. Video phones came out when I was about 16 years old and a lad i knew got charged with making and distributing child porn for filming himself masturbating and Bluetooth'ing it to several girls. His sentence was light due to age but he ended up on the sex offenders register nonetheless. He couldn't find work when i spoke to him bout 2 years ago.

A young woman (16, so that is young!) takes nudies of herself and publishes them! Good on her! There appears to be no coercion or abuse here! In Pin-Universe, this would not make you a "sex offender"! :blink:

This happens here too. Video phones came out when I was about 16 years old and a lad i knew got charged with making and distributing child porn for filming himself masturbating and Bluetooth'ing it to several girls. His sentence was light due to age but he ended up on the sex offenders register nonetheless. He couldn't find work when i spoke to him bout 2 years ago.

This "lad" has clearly failed to be a "gentleman". Hardly a sex offender!

I might be a bit old fashioned, but I've never emailed a picture of my ****, to chicks! I've usually shown them the real thing! :blink:

Well, that can get you arrested depending on the context as well.

Regarding the above cases, surely someone just needs to exercise a bit of common sense. A bit of a scare from a top bod at the local copshop while outlining the possible consequences of being so stupid in the future is all that's required surely. Agreed the sexting educatoin programme sound sensible.

Providing they aren't harming anyone other than themselves I think we should give teenagers a bit of leeway to be stupid.

"Common Sense" is rare in the real world, even if HPC still has some left! :(

Whats the chance of these pics making an adult site? Anyone viewing them will be breaking the law but it will be impossible to work out if shes 16 or 18.

Stupid giving her a criminal record and clearly the child porn laws are fast becoming unworkable. The question over naked selfies or two consenting teens taking pictures of themselves in the act are questions everyone wants to avoid.

"child porn" laws should only be aimed at predatory "nasty people" who want to do "bad things" to unconsenting minors! :blink:

Interestingly, in the UK, if she was giving free shows in person behind the bike shed it would all be legal, as long as one of the viewers wasn't a teacher...car mechanics, politicians, bankers and the spotty kid who works at the bakery are fine though.
