France - You Could Be Sued For Lack Of Sex

The 51-year-old man was fined under article 215 of France’s civil code, which states married couples must agree to a “shared communal life”.

A judge has now ruled that this law implies that “sexual relations must form part of a marriage”.

The rare legal decision came after the wife filed for divorce two years ago, blaming the break-up on her husband’s lack of activity in the bedroom.

A judge in Nice, southern France, then granted the divorce and ruled the husband named only as Jean-Louis B. was solely responsible for the split.

But the 47-year-old ex-wife then took him back to court demanding 10,000 euros in compensation for “lack of sex over 21 years of marriage”.

So if one partner cheats now because of the lack of sex can they also sue the other half and get damages for the trauma of having an affair as well, and claim back all costs relating to hotel use etc??

Will be interesting what happens if a husband sues his wife for refusing sex with him.

I think that they should concentrate on getting the mountains of dog shit off their pavements before they start analysing sex-drives.

+100 (= tree and a turd plus tree and a turd plus tree and a turd) I've never understood how people can love Paris when it is more or less knee deep in dog sh!t...and what do the French feed their mutts? Nothing like that has come out of any do I've owned.

This is true its part of civil law or rather your expected responsabilities in a couple

She was lucky because an average 3 French women die everyday often beaten to death by there partner

Just about everyday here women often young are kidnapped ,raped and a 17 year old girl who went jogging not far from here home in the Ardeche

her burnt body was found a few days later

What else an average of 12 people a day die here on the roads in my Dept 2 dead yesterday

There are over 5 million laws in France but many are not enforced

A curious but important law is not helping somebody in danger eg if somebody takes ill and fell down in a street and you walk past but don't offer to help them than you are at fault

The police can take you to court

You sure? It looks like about one every five days according to this (still too many though)

"In France, a woman dies of domestic violence every five days", explains Professor Roger Henrion, member of the National Academy of Medicine and responsible for this study for the health ministry.

The professor's team questioned a random sample of 7,000 women between 20 and 59 years old, living in Paris and its immediate suburbs. They found that 10% have been the victim of domestic violence during the past 12 months. Insults, moral harassment, physical attacks, rape, the list is long of these abuses committed in the intimacy of couples.

Insults are considered "violence". Oh my. Still, it's one way to crank the numbers up.
