Michigan: Police Search Cell Phones During Traffic Stops

ACLU seeks information on Michigan program that allows cops to download information from smart phones belonging to stopped motorists.

CelleBriteThe Michigan State Police have a high-tech mobile forensics device that can be used to extract information from cell phones belonging to motorists stopped for minor traffic violations. The American Civil Liberties Union (ACLU) of Michigan last Wednesday demanded that state officials stop stonewalling freedom of information requests for information on the program.

ACLU learned that the police had acquired the cell phone scanning devices and in August 2008 filed an official request for records on the program, including logs of how the devices were used. The state police responded by saying they would provide the information only in return for a payment of $544,680. The ACLU found the charge outrageous.

"Law enforcement officers are known, on occasion, to encourage citizens to cooperate if they have nothing to hide," ACLU staff attorney Mark P. Fancher wrote. "No less should be expected of law enforcement, and the Michigan State Police should be willing to assuage concerns that these powerful extraction devices are being used illegally by honoring our requests for cooperation and disclosure."

A US Department of Justice test of the CelleBrite UFED used by Michigan police found the device could grab all of the photos and video off of an iPhone within one-and-a-half minutes. The device works with 3000 different phone models and can even defeat password protections.

"Complete extraction of existing, hidden, and deleted phone data, including call history, text messages, contacts, images, and geotags," a CelleBrite brochure explains regarding the device's capabilities. "The Physical Analyzer allows visualization of both existing and deleted locations on Google Earth. In addition, location information from GPS devices and image geotags can be mapped on Google Maps."

The ACLU is concerned that these powerful capabilities are being quietly used to bypass Fourth Amendment protections against unreasonable searches.

"With certain exceptions that do not apply here, a search cannot occur without a warrant in which a judicial officer determines that there is probable cause to believe that the search will yield evidence of criminal activity," Fancher wrote. "A device that allows immediate, surreptitious intrusion into private data creates enormous risks that troopers will ignore these requirements to the detriment of the constitutional rights of persons whose cell phones are searched."

The national ACLU is currently suing the Department of Homeland Security for its policy of warrantless electronic searches of laptops and cell phones belonging to people entering the country who are not suspected of committing any crime.

A hidden file in iOS 4 is regularly recording the position of devices.

Today at Where 2.0 Pete Warden and I will announce the discovery that your iPhone, and your 3G iPad, is regularly recording the position of your device into a hidden file. Ever since iOS 4 arrived, your device has been storing a long list of locations and time stamps. We're not sure why Apple is gathering this data, but it's clearly intentional, as the database is being restored across backups, and even device migrations.

The presence of this data on your iPhone, your iPad, and your backups has security and privacy implications. We've contacted Apple's Product Security team, but we haven't heard back.

What makes this issue worse is that the file is unencrypted and unprotected, and it's on any machine you've synched with your iOS device. It can also be easily accessed on the device itself if it falls into the wrong hands. Anybody with access to this file knows where you've been over the last year, since iOS 4 was released.

Why on earth do any of you folks want to travel to the US?

There are a few reasons why I'd like to go to the US though admittedly. Yosemite park has a perfect BASE jumping location (though the Milau bridge is even better).

Also sky festivals are held there quite regularly out of massive aircraft, Perris has a converted DC10 which can cram 100s of jumpers on board.

If you are a tourist, planning a week in an American State. New York for instance. You are fingerprinted as soon as you land. A growing number of airports have the 'Naked Body Scanning machine' as well.

I read a year or two back, [under our fascist pals Labour] that our very own Home Office were trying to introduce legislation to install those TSA Body Scanners on every lampost in London. [To see if anyone was carrying explosives in Backpacks, or wearing suicide belts. :rolleyes:]

Make no mistake. If governments thought they could get away with it, they care not a jot about your civil liberties. They will continue to push the envelope, and use technologies which infringe, and destroy our civil rights.

Wont be long before we see 'Minority Report' type technologies. Eye Scanners, which greet you as you enter shops etc....

Not a world I would want to live in.

Labour's innacurate interpretation of isaiah berlin's negative and positive liberty philosophy, twisted to suit their own purposes, led Blair and Co to the conclusion that if you watched everyone all of the time, people would have less to fear.

That of course is utter balls. It was just a form of control. And a way of taxing us into oblivion.

There is little evidence that CCTV deters crime; in fact, there is considerable evidence that it does not. And there are more Cameras [CCTV] in the UK, per person, than any other country in the world.

Opposition Politicians like David Davies were screaming about Labours infringment on our civil lberties, but the Tories have done nowhere near enough to correct the evils put in place by Labour. Although they have addressed some issues like the extradition treaty with the United States.

Just wait until they have the technology, to create a chip that can read your mind, via emotional responses, and find some excuse to 'tag' the entire population. A chip that tells them everything about you.

Dont kid yourself. That's not an unrealistic future scenario.

It is a lovely country if you are of the right persuasion (ie rich). Plenty to do as you have highlighted. Also, the women seem to go wobbly when you put on a Queen's English accent. :P

El Capitan.

There have been quite a few base jumpers who have jumped off there but kind of left their canopies behind.

People chill out on top waiting for the right conditions, they chill, relax, chat with friends, have a bite to eat, unbuckled the harness whilst chilling, have a drink and admire the view... suddenly, the conditions are perfect, the wind is just right, they get up all excited, run to the edge and jump... forgetting that they unbuckled their harness half an hour ago.

They have made the Darwin Awards.
