Council Tax--debtor's Prison

Pensioners sent to prison for non-payment of council tax sounds as if the Government have re-instated debtors prison. This practice was outlawed over two centuries ago as it was felt that no one should suffer imprisonment (or deprtation to OZ) for indebtedness. The law, as it stands, is a brutal means to force people to pay taxes they are unable to pay. In more civilized countries the government is forced to pursue a nonpaying homeowner through the civil courts. The result is a lien against the property or, in serious cases, foreclosure/reposessession. But imprisonment? Does anyone know of any country where people are sent to prson for not paying their property taxes (police states excluded)?

Who do you think will be paying the taxes to fund all those 'government services' if the old farts don't?

If they can't pay, they can go bankrupt. They're currently imprisoning people who could pay but won't, which isn't quite the same thing.

A retired social worker has been jailed for a week for refusing to pay her council tax arrears.Sylvia Hardy is the first woman pensioner to be sent to prison for the offence.The 73-year-old from Exeter, Devon, failed to pay her arrears of £53.71 from last year - plus £10 costs.

In June she was given 56 days to settle the bill - or face a week behind bars.

The chairman of Exeter Magistrates' Court chairman Louis Crowden showed little sympathy in jailing her.

"If everyone paid their debts on the basis of what they thought appropriate this country would descend into anarchy," he said. He added: "You may think you are a martyr but you are not."

What planet does this guy live on I thought the country had already descended into anarchy.

Magistrates, Judges, and Politicians are my favourite Aunt Sallys.

I believe a 20 year old and a 21 year old have just been appointed as Magistrates, well that`s going to create a revolution in the lower courts. :)

So you can buy a house you can't afford, a car you can't afford, fill the house with unless tat you can't afford on a Credit Card and then declare yourself bankrupt and get discharged within 18 months with seemingly little consequence and active encouragement from the government given their rules, but if you forgot to pay your council tax on the house you thought you owned, opps, that's it, off to clink you go!

Sums this country up perfectly.

So will council tax debts get added to the list of debts you can't get rid of whenn you go bankrupt?

No, I think it's specifically excluded, from what I've read it's dealt with through a different court and they may let you off, or not.

Suspension of Habeas Corpus

Imprisonment for glorifying terrorism

Compulsory medical treatment for people 'suspected' of being an anti-social risk

Three months internment for 'suspected' terrorists or terrorist sympathisers

A huge database of people 'suspected' of committing a sex-crime which includes visiting a prostitute

Do you notice a trend ?

A lot of pre-emptive action and action based purely on what they suspect may be the case.

It is this willingness to deny individuals their liberty based upon the suspicions of party apparatchiks , social services and the police which make new Labour an Orwellian party in a way the Conservatives never could be.

This is because of THE fundamental axiom of socialism which states (more or less) :

We are all born perfect and pure and have the makings of perfection within us , if we are not perfect when we reach adulthood then it is either a malfunction of society or the individual or both.

We can remedy society which is a slow process and we can also remedy the individual through re-education alone or incarceration with re-education or compulsory medical treatment with re-education.

hello

sylvia visted the old vicar albert that is in prison just now for the same thing.

there is a campaign from the site www.isitfair.co.uk

we are always looking for new members young and old that feel this tax is unjust.

remember someone earning only minimum wage and taking home about 9k a year is still having to pay full council tax, the same as a guy on 100k.

I think ya all can agree this is wrong its not just pensioners that are suffering.

new members are always welcome there, it was members from there standing outside the courtroom today protesting about this old lady going to gaol.So please join up and join the campaign to get rid of this crazy tax.

Devils advocate here.

She should pay the council tax. If she can afford to live in a substantial home, and maintain it then she should pay the council tax imposed or sell up/downsize.

The goverment has already shelved plans to re-catorgorize homes for the council tax banding, so she thank her lucky stars she hasnt had to pay even more council tax.

I dont agree with council tax that I pay - I make cuts etc... heck we all voted Labour again... Why are we complaining then..?

Higher taxes is going to be one of the saviours to you and others who are waiting to buy their own home.. The end effect is driving house prices down. Is that not we all want eventually? It will look blatantly silly if the council demand more council tax for homes worth 50% of prices they are now. We forget that alot of people are sitting on a lot of equity - why should they not pay up??? In the short term the low incomes are going to suffer agreed - but the ends will justify the means. Discuss!

Why shouldn't she pay the cost of the 'services' that she uses? Why should the old farts offload those costs onto their kids and grandkids instead?

This is the whole problem with socialism: once you disconnect the cost of services from the users of those services, it just becomes a war of all against all as everyone tries to offload their costs onto their neighbours.

No question that she should pay. The alternative would be to make taxes optional.

However, would it not be easier to use the usual procedures for other debts? Imprisoning a misguided old lady is not exactly something that a civilised society should do. It would surely be better to give her a CCJ and charge the costs to make sure no-one else pays for her 'brave stand'.

I think that a good case can be made for increasing the accountability of councils that spend the money raised via council tax. Where I live, they are known to have wasted milions through what appears to be sheer incopetence. Any thoughts on how this could be achieved (and whether it would be desirable)?

Only 36% of the voting pop voted for Nu Liarbour. If you voted for them then you are indeed a short-sighted asshole.

Are you a sheep? This equity you are talking about is a paper profit that can only be realised by sale of said property. It is not money in the bank therefore the woman is not rich. Are you advocating that she mew just to pay her council tax bill? Congratulations, you have just proved that you have swallowed the VI stance hook, line and sinker.

I think she should pay – just because she feels that she should not pay because she is old is not good enough in my books – a tax is a tax no matter your circumstances

Although if she had said I’m not paying because I am not getting value for money or I’m only paying half of it as that is all it’s worth because the council / police/ bin men are not doing there job

I would have been right behind her!

Send people to prison to collect debt is frankly ludicrous. The magistrates who sent the old dear should be given the bill for her imprisonment. If she owns property the council should obtain a charging order and get their money when she dies if she owns nothing they should take it on the chin and write it off.

Not everyone paying council tax owns there own home.

And she aint saying she shouldnt pay something, shes protesting about why the increases are so much more than her pension increases.

The council tax is every year taking a greater chunk of peoples income it is rising at 3 times the rate of inflation yoy.

Most of the increases councils have given were not to give more services to the community but were to top up there depleted very generous pension schemes or there workforce, a workforce rising by the day as anyone on this forum will know.

There were holes in the pension funds and they increased the taxes to plug them up, these holes occured because of the final salary pensions given to council employees on ever increasing wages that are rising above the prvt sector.And to kick off the pension schemes of all the new people that the councils have employed.
