This is the latest report from Allsops after their recent auction.

It makes for interesting reading.

Does anyone know how "fixed charge receivership" works? I am not sure what they mean in the article.

This was the first auction after the summer recess and there is no doubt that the correction that we witnessed at our July sales (£43m and 83%) heralded tougher times ahead. The market has weakened further.

We are increasingly noticing a difference in buyer sentiment to lots in the south-east and those in the regions. We have historically held two day sales, one day offering regional stock, the other concentrating on London and the home counties. The recession has brought with it a flight to quality as debt starved investors shun risk and stick to the safer locations.

This was evidenced by a strong attendance at our 16 September sale when 232 south-east lots were offered and 207 were sold. £28m was raised and 89% achieved.

Lenders have continued to show forbearance towards borrowers struggling to service mortgage debt. This is particularly true of the partly nationalised institutions for whom large scale repossessions would cause political embarrassment. Many have opted for the fixed charge receivership route to recovery. The appointment of a receiver leaves the mortgagor in possession whilst offering a fast track route to market to the lender. Our in house insolvency team specialises now in such a service and is one of the firm's busiest departments. We see this continuing for some years to come.

In summary, the following points are worthy of note from the sales:

• Less well located investment stock will only attract interest at high double digit yields. This reflects the risk of a difficult sale in the event of vacant possession. (Lot 50 AST Middlesborough 21%. Lot 95 AST Prestwich 16%)

• Better regional locations show lower returns. Buyers need to have confidence in vacant possession values and a sustainable owner occupier market. (Lot 75 Tenancy Stockport 4.28%. Lot 105 AST Wetherby 5.7%)

• The regions, particularly the north east and north west conurbations, are increasingly weaker. Market confidence is being eroded by proposed public sector cuts.

• The traditional investment market in London and the south east remains strong with no perceptible variation on results from our May and July sales. (Lot 276 AST Lauderdale Mansions, Maida Vale, London W2 7.4%)

• 100% of all regulated tenancy investments sold.

• The ground rent market is still showing great resilience. 79 investments sold from a total of 80 offered.

• Vacant homes in good areas remain particularly saleable.

• All sites with planning permission or potential for residential developments were sold. This sector of the market showed early signs of correction around 18 months ago. We therefore attribute this success to vendors adopting a more realistic approach to pricing based upon recent market evidence.

• Yield analysis

I have pointed out before that a 'slump' 'aint going to happen in the SE, which is why I bought a house (albiet at 2004 prices) at the end of last year. I saw a rare oppourtunity to pick up a bargain in the Winter which is what I did. Prices have contiued to rise, which I found surprising, expecting stagnation here.

Apparently 'Realistbear' has seen prices slumping in Sussex, but as I've pointed out, no one wants to live in Hastings rolleyes.gif

Hey, my sister managed to pay the 2006 price for a house in St Leonards* in 2009, so that's not entirely true...

* due to the large number of drug addicts Maggie shipped off to there in the '80s, it's known locally as "St Leonards-on-Smack"

I have pointed out before that a 'slump' 'aint going to happen in the SE, which is why I bought a house (albiet at 2004 prices) at the end of last year. I saw a rare oppourtunity to pick up a bargain in the Winter which is what I did. Prices have contiued to rise, which I found surprising, expecting stagnation here.

Apparently 'Realistbear' has seen prices slumping in Sussex, but as I've pointed out, no one wants to live in Hastings rolleyes.gif

Pyramids and Ponzis collapse from the bottom up.

The next stage (which will take time) is when people realise they can get far more for there money in slight worse area, as the difference between good and not so good areas becomes too large and they start opting for the comparatively worse area, this combined with more sensible mortgage rules and rationing will start to bring down the better areas from the outside.

The confirmation from a VI that there has been a flight to quality indicate that the house price falls have been bigger than the stats say, as the average house selling now is better "quality" :rolleyes:

Here in South Wales that seems to be what is happening now.

Nothing seems to of been selling for a while now, in the cheaper areas such as the valleys and Bridgend, despite price reductions.

Exactamundo - its basically a ripple effect. And when buyers realise that for an extra 10 minutes commute they can have the same house for 30% less, demand in these 'prime' areas decreases and prices fall (and all the smug tw4ts who say these areas will not be touched by an HPC are left with egg on their faces :D )

Besides, markets are frothier at the top.

Edit to add: I agree that prices in good areas are holding up, like here in the South, in Brighton, Arundel, Chichester. And they will probably be amongst the last to fall. But fall they will, eventually.

I know, I am very "Tired of Waiting" as well! But I much prefer to wait until the right time/price, and then pay it all off as fast as possible! In just a few years, with a bigger deposit and lower prices, it will save me many years of mortgage payments.

I know, I am very "Tired of Waiting" as well! But I much prefer to wait until the right time/price, and then pay it all off as fast as possible! In just a few years, with a bigger deposit and lower prices, it will save me many years of mortgage payments.

Just as a matter of curiousity, if you don't mind ... how old are you, what do you do for a living, are you married, do you have/want children and ... if Arundel and Chichester hold up forever ... nothing happens for 5 to 10 years and then prices start picking up again (for example) ... how long are you prepared to wait?

That seems pretty risky to me -- basically says that the market is ignoring any impact of the changes in Local Housing Allowance. As 40% of private tenants in London are on housing benefit and the largest impact of the changes will be in London, it seems hard to believe that there won't be an effect on rents in a year or two, especially as the areas where these buildings are located (Peckham, Ealing, etc.) aren't exactly high end.

450k in an outer West London suburb buys you a 1930s 3 bed semi. 2 12' x 12' receptions, a small kitchen, 2 double bedrooms, 1 boxroom, 1 bathroom. Possibly shared drive with single garage to rear.

450k 30 minutes down the M3 buys you a nice 4 bed detached, detached double garage, in a nice area etc. You get about twice as much house for your money just an extra 30 minutes away. By train the commute probably takes just another 20 minutes.

You said ... 'and when buyers realise' ... do you think they don't realise now? What do you think will happen to make them suddenly aware that 30 minutes away by car they can get double the value for their money? Why don't they realise now?

Just as a matter of curiousity, if you don't mind ... how old are you, what do you do for a living, are you married, do you have/want children and ... if Arundel and Chichester hold up forever ... nothing happens for 5 to 10 years and then prices start picking up again (for example) ... how long are you prepared to wait?

With the incoming cuts (6%/year, starting in April 2011, totalling 25% in April 2014), and the incoming crisis (BTW, the crisis didn't even start yet!, "you ain't seen nothing yet".), no area in the country will "hold up forever", and not even for 5 years. You can be 100% sure about that. Why? Because even if we had an insane government, we would not have credit enough to keep running a 11% annual deficit for 5 years. This one is just mathematical. Don't worry, prices will crash.

Actually, unfortunately, it is Britain that will crash. Unavoidably, and tragically.

Edit: On our personal timing, we decided to rent a better place, with a contract for 2 or 3 years, and then consider buying. It should be enough to get most of the reductions. We don't need to wait for the very bottom.

And our main goal is financial independence. A paid off mortgage is a major aspect of it. Meanwhile, having to pay rent or mortgage interest doesn't make any difference.

I should have been more specific - I meant when prices fall 30% in these non-prime areas (there will always be a price differential). There comes a point when prices fall sufficiently in less desirable areas to tempt buyers in who otherwise would have bought (and pushed prices up) in prime areas, thus beginning to stabilise prices in non-prime areas and drop prices in prime areas.

Look at the yields mention in the OP - there comes a point when the yields in these non-prime areas become too good to ignore and so demand for prime areas drops.

Fixed Charge refers to a debt secured against an asset. What the lender is saying is we have a charge of £xx secured against these assets. The lender reserves the right to appoint a receiver or administrator if the borrower defaults or other specified situations arise that may result in the lender not being able to obtain repayment of the loan.

Used only to be found in corporate or small business loans. Residential mortgagees have cottoned on and now use this procedure. A receiver can be appointed who will take charge of the asset. He may allow an owner/occupier (there may be some specific provisions in the Law of Property Act to be complied with) to remain in residence or collect rent from it. From the mortgagees point of view it is an easier process than repossession, a receiver can be appointed very quickly and does not need the permission of The Court.

I'm having some interesting conversations with a mortgagor who has had an LPA receiver appointed to control some apartments he owns. The LPA Receiver has not found tenants for them for over 18 months despite the fact that I have received enquiries from potential tenants for them as soon as they became vacant.

The appointment of a receiver leaves the mortgagor in possession whilst offering a fast track route to market to the lender.

So these 'virual repossessions' look like they are setting up a powderkeg. When/if the lenders suddenly start to turf people out (and they will do it in a co-ordinated way because banks love to engage in herd behaviour), there is more likely to be a glut of repossessed properties than if they went the traditional route?

Or am I reading it wrong and what they're saying is that the receiver sells the place with the former owner in place as a tenant??? (Hence the fast track route to market). But who would want a tenant that couldn't keep up on its mortgage repayments as their tenant on the same property?

Used only to be found in corporate or small business loans. Residential mortgagees have cottoned on and now use this procedure. He may allow an owner/occupier (there may be some specific provisions in the Law of Property Act to be complied with) to remain in residence or collect rent from it.

Do they mean that they are now doing more business selling properties that are ready tenanted with the original home owners still living in them, after they have made an arrangement with the receiver to stay on, and rent their own property? And in some cases these tenants (indebted owners) do not have to pay any rent at all?

For example I noticed one of the auction properties see below, .Has the indebted owner of this place been living there on nil rent since May 2008 at least, because no-one wants to buy it?

That is a similiar question there, as to what I am asking.

Maybe not many do want such tenants, because there seems to be many unsold investment lots listed from that last auction,showing as being sold by Receivers, and listing current rents for various amounts. One of which I found, even said nil rent.

I've tried matching up these auction results to past sold prices from the Land Registry. I've binned most of the rubbish like ground rents, withdrawn lots, bad matches and so on but some will remain. Check the house numbers carefully in the data below.

I think the auctions are the place for us to watch now.

Most that are selling, seem to be well down in prices paid in the past.
