Need Advice On Buying A Property

Hi all, new guy needing advice please.

I am looking to buy two semi-detached cottages together. Surrounding the cottages are green fields and a barn conversion approx 30 metres away. The shared drive and yard serves all three properties. The barn is privately owned and the two cottages are owned by an estate. The owners of the barn have an easement for access and use of the drive and a small area of the yard is owned by them for parking. The yard is approx 30m2 plus the allocated parking spaces for all three properties.

My problem is:- the estate wishes to retain the ownership of the yard while giving me access. My concerns are - why would they want to do this? What if I lost access to the yard? What if they built property on the yard? Can anyone else think of anymore reasons the estate would want to retain ownership of the yard?

I really would appreciate any help on this matter as I am very worried.

That's one for your solicitor I would say, but I'd be very concerned about buying a house with no guaranteed access - what if you fell out with the owners or they refused to give access to the person who wanted to buy it next. Since you have concerns, any future buyer is likely to have the same concerns.

Still, there may be genuine reasons which you would need to speak to a solicitor about to confirm.

You (and your solicitor) will have to make sure that the access rights are cast in stone and cannot be recinded.

Apart from that,I can't think why they would want to do this

Many thanks for your response - it is much appreciated. I do have a solicitor - who will advise me - but it is always better to have other opinions which are very useful. I will endeavor to keep you all updated with my solicitor's advice.
