Can Contract Be Ended Earlier By Ll?

I have just negotiated a 12 month AST and was under the impression that I was assured of the tenancy for that period of time (hence the name - ASSURED shorthold tenancy).

However, a friend of mine has just been given notice to quit her AST well before the end of the tenancy.

Can anyone advise on the legal position here? I don't want to spend the next 12 months worrying that I may be given 2 months notice.

You friends landlord may be using what is known as a 'breakclause', present in her contract. A breakclause is reasonably common in 12 months ASTs and it allows either the landlord or the tenant to end the agreement between the 6 month and 12 month period by giving prescribed notice. The required notice could be anything (normally at least one month).

You need to check if your particular contract (and your friends) contains such a breakclause.
