Terms Of Lease: "no Letting"?

Hi everybody,

this is my first post on this forum.

I recently got interested in a property which is advertised as a leasehold.

Up to here - nothing special.

However, it is said that "The terms of the lease do not permit letting or pets".

What does this mean? That I cannot let the property out later? :blink:

This is the first for me to see such a clause.....

Maybe some of you encountered this before?

Well.... I mean - clearly it means what it says but.....

Is it possible? To me, it looks more like a typo or something like that.

Can't be true!

I've lived in flats and had to keep quiet about being a tenant. The lease specifically says that they are not allowed to let them out. Lots of LL's do it anyway.

Not sure how enforceable this is or even if the owners are reading their leases correctly and it means something entirely different. Widely ignored in my experience.

Thanks Flopsy. It maybe widely ignored - and yet I wouldn't feel comfortable to do it. I'm a foreigner and supposed to obey the rules............. ;)

How long is the lease for? Years??

It's one of those 999 years long leases....... Good, but apparently with strange clauses.....

Is it an older "mansion block" type flat? I've only seen this clause in the older leases. May be a historial reason why they were written like that.

No, it's not old at all... It's about 30/35 years old............. <_<

It is so that you have a block of owner occupiers. It stops a building filling up with buy to let investors sub-letting. Us renters are scum.

You need to check what the lease states!

When i purchased my flat i was told we couldn't let the property out or have pets, however I read over the lease some years later and found that you can rent as long as you recieve the permission of the freeholder, which by law they can not unreasonably refuse!!!!!!!

People get confused as most leases will state " must be only in the occupation of the leasee and his/her family" so they automatically think that you can't rent.

Yet, futher on in the lease it will state" must not sublet with out permission of the lessor in writting and the contract between leasee and the sub-tenants must contain the same convenants etcccc"

So when you sub-let the property to a tenant their contract should state that the property can only be occupied by the sub-tenant and his/her family and any other convenants that you have to abide to.
